KK&P and Al Tamimi & Company to Host Joint Session at Dubai Arbitration Week 2026

As part of Dubai Arbitration Week 2026, KK&P Trial Lawyers and Al Tamimi & Company will host a joint session titled “Structuring Cross-Border Deals with Russian Parties: Preserving Foreign Dispute Resolution amid Sanctions and Insolvency Risks.”

Sanctions, jurisdictional disputes and emerging insolvency risks are reshaping the way international businesses approach transactions with Russian counterparties. Even a carefully drafted arbitration or jurisdiction clause may not guarantee that future disputes will be resolved in the agreed forum.

The session will bring together Russian and UAE legal perspectives to examine how businesses can preserve access to foreign dispute resolution mechanisms.

Key topics will include:

  • Which DR clauses work today: Which agreements Russian courts recognise as valid and enforceable, and which may create a risk of disputes being heard in Russia.
  • How Russian parties could circumvent the agreed forum: How Russian countersanctions, public policy arguments and insolvency proceedings may be used to bring disputes before Russian courts despite an agreement on dispute resolution.
  • How to structure transactions to reduce these risks: Practical considerations when choosing governing law, drafting dispute resolution clauses, using foreign subsidiaries as contracting parties and arranging security.

The discussion will be moderated by Igor Gorchakov, Partner at Al Tamimi & Company.
