Nikolay Pokryshkin to participate in the Forbes Federal Legal Forum
On 18 September, KK&P Partner Nikolay Pokryshkin will speak at the session entitled Business in the Face of Sanctions: the Boundaries of a Legal Personality, which will be dedicated to the issue of the limits of liability of affiliated companies of foreign companies based on the decision of the Russian Supreme Court in the Citibank case.
The main topic of the session will be a discussion on the risks for large foreign companies in Russia and options for Russian businesses to protect their interests.
Having extensive experience representing the interests of major foreign banks in disputes arising out of an inability to fulfil obligations due to sanctions, Nikolay will consider the following issues:
- the significance for Russian courts of the introduction of foreign sanctions against Russian individuals;
- why Russian lower courts ignore foreign sanctions and their legal effect in some disputes with a foreign element, while in other court decisions (including decisions of the Russian Supreme Court) these sanctions are recognised as key and have a decisive significance for the consideration of the case.
