Maxim Kulkov, managing partner of KK&P Trial Lawyers, arbitrated a live mock demonstration, in which the fact pattern involved one of the parties seeking to obtain and use discovery from the United States using the Section 1782 process in a Russia-seated arbitration.
Section 1782 is a federal statute that allows a party of a legal proceeding outside the United States to apply to an American court to obtain evidence for use in the non-US proceeding.
