Maxim Kulkov will be speaking at a seminar “A Multi-Tier ADR Clause: Is It Efficient for Your International Transaction?” by ICDR Young & International and RАА40 (7 December)
KK&P’s Managing Partner Maxim Kulkov, Director of the Mediation Resource Centre at the RSPP (the Russian Union of Industrialists and Entrepreneurs), will share his experience and successfully completed extrajudicial dispute settlement projects. Those include out-of-court settlement of disputes relating to the construction of a shopping center, an accident in a warehouse for a logistics company, the lease of railcars, the recovery of debt from a businessman, etc.
The seminar will be held in English.
Multi-tier dispute resolution clause provides that contracting parties must engage in negotiation, mediation, seek independent expert’s services or some other form or combination of alternative dispute resolution prior to commencing arbitration/litigation, in an attempt to amicably settle the dispute. The discussion will focus on the reasons parties agree to such dispute resolution mechanism, the benefits and negative effects of multi-tier dispute resolution, and treatment of these clauses by national courts.
