Maxim Kulkov to participate in the UNIDROIT Principles of International Commercial Contracts – the Neutral Law of Global Trade RAA Webinar

Amid growing uncertainty and the increasing complexity of cross-border transactions, the choice of applicable law is becoming a strategic decision. The use of national law often carries risks–from unpredictable interpretation to an imbalance in the parties’ interests. An increasingly frequent alternative is Lex Mercatoria, including the UNIDROIT Principles of International Commercial Contracts, a transnational system of legal norms tailored to the needs of global trade.

On 8 April, the Russian Arbitration Association (RAA) will hold a webinar entitled UNIDROIT Principles of International Commercial Contracts – the Neutral Law of Global Trade in a live discussion format, featuring KK&P Trial Lawyers Managing Partner Maxim Kulkov.

Maxim will initiate a discussion on the principle of Lex Mercatoria and will address the following issues:

  • The concept and sources of Lex Mercatoria;
  • The UNIDROIT Principles: history, objectives, and interplay between civil law and common law systems;
  • How to incorporate Lex Mercatoria into a contract (drafting techniques and how to persuade the counterparty to apply Lex Mercatoria), and
  • Whether arbitrators may apply Lex Mercatoria at their own discretion.

 

Maxim has over 30 years of experience in international commercial arbitration as an Expert, Arbitrator and Tribunal Chairman, as well as a Counsel involved in the selection and appointment of experts to prepare reports in support of clients.

The other speakers will be Roman Zykov (Arbitration Association), Alexei Dudko (Level Legal), and Stepan Sultanov (KIAP).
