Maxim Kulkov spoke at two sessions of C5’s Fraud, Asset Tracing & Recovery Geneva conference on 15–16 March
On 15 March, KK&P Managing Partner Maxim Kulkov took part in the Rogue Directors and Deep Pockets session. Its participants discussed methods of asset withdrawal in cases of corporate fraud revealed during well-known trials and the defence of private companies’ employees who reported fraud by senior executives. They also compared effective ways of disclosing withdrawal of company assets in different jurisdictions, including in Russia.
On 16 March, Maxim Kulkov spoke in the Too Hot to Handle? Hacked, Stolen or Just Mislaid? What to Do when Privileged or Confidential Data Lands in Your Lap – a Tale of Modern Day Ethics! session. The expert panel discussed national approaches to using evidence which was not lawfully obtained, the duty to disclose the means by which such evidence was obtained and risks for the litigant and the lawyer. They also compared the approach taken in England and Wales with that of other jurisdictions, including Russia. Maxim Kulkov discussed a “semi-legal” zone of evidence in Russia and in which cases it is possible to use secretly recorded audio material (including the telephone conversations), video records, personal photos, private third-party correspondence, etc.
